Running a business is not always smooth – particularly in these uncertain times of the pandemic which have disrupted international mobility. One of the important aspects that business managers need to be fully prepared about, is how to handle conflicts and business disputes with legal channels when needed.

This webinar, organised with the Chinese Italian Chamber of Commerce (CICC) will provide you an overview of frequent disputes that could arise between European companies and their Chinese partners; it will then explain to you two major dispute resolution mechanisms in China – arbitration and litigation, so you know where and how to get help when disputes arise. This webinar will also discuss some of the successful cross-border commercial disputes handled by our speakers.

During this webinar you will learn fundamental knowledge of how Chinese domestic judicial system works, including a structure and function of the People’s courts at all levels, consist of judicial personnel, and conduct of different trails. You will then learn the general principles of arbitration, and most importantly the pros and cons of litigation and arbitration in different dispute cases and scenarios. You will also have certain practical tips on how to avoid future disputes with Chinese partners.

About the Speakers

Suyu Yuan – Partner, Hogan Lovells Fidelity

Suyu Yuan is a seasoned lawyer with a proven track record in litigation and dispute resolution procedures, notably in commercial and IP cases. After completing his legal studies at the East China University of Political Science and Law, Suyu qualified as a lawyer in Shanghai in 2006, and joined Hogan Lovells Fidelity in 2016.

Suyu has handled numerous litigation cases, accumulating a wealth of experience in representing clients in large-scale, multi-jurisdictional disputes involving contracts, corporate equity, and IP enforcement. Suyu’s rich litigation experience allows him to provide valuable, practice-based advice to his clients whether handling a commercial deal, a business restructuring, or IP enforcement.

Suyu has a technical background in the field of Thermal Energy and Power Engineering and has passed the Chinese Patent Bar. This allows him to quickly grasp complex technical and legal concepts when handling matters involving technology.

Elaine Yao – Associate, Hogan Lovells Fidelity

Elaine Yao is an associate with Fujian Fidelity (Shanghai) Law Firm (“Fidelity”), the Chinese law firm with which Hogan Lovells has entered into an association in the Shanghai Free Trade Zone (the “Association”).

Elaine’s practice focuses on intellectual property, and commercial litigation and arbitration. She has handled various litigation cases relating to IP infringement, equity ownership disputes, and unfair-competition disputes. From time to time she also advises clients on commercial legal matters, compliance and IP issues.

Prior to joining Fidelity, Elaine worked at a renowned PRC law firm.
